Heard the learned counsel for the petitioner and the learned Government Pleader for the respondents.

The case of the petitioner is that he is resident of Mahadevpur Village and Mandal, Karimnagar District. He is running a small hotel in an extent of 181 square yards, near MPDO Office for the last 15 years and eking out his livelihood. He was granted permanent house site patta for the said land on 04.12.2001 by the 1st respondent. While so, on 19.07.2005 and 20.07.2005 the respondents visited the site and directed the petitioner to vacate the land. The said action was taken by the respondents without issuing any notice or passing any orders. Challenging the said action, the present writ petition was filed. This Court, by order dated 22.07.2005, directed the respondents not to dispossess the petitioner without following due process of law, and the said order is subsisting till today. No counter affidavit was filed by the respondents even after 9 years.

In the circumstances, the Writ Petition is disposed of, directing the respondents not to dispossess the petitioner from the land of an extent of 181 square yards, for which, permanent house site patta was granted in his favour by the 1st respondent, vide proceedings dated 04.12.2001, without following due process of law. No order as to costs.

Pending miscellaneous petitions, if any, shall stand closed in consequence.
