ORAL ORDER:
This writ petition is filed contending that third respondent is trying to dispossess the petitioner from the land admeasuring Ac. 1.38 cents in Survey No. 88-2 Thurpuboyamadugula village, Varikuntapadu mandal, Nellore district. By order dated 5.1.2016 this Court directed third respondent not to physically interfere with the petitioner's land in an extent of Ac.1.38 in Survey NO. 88-A of Thurpuboyamadugula village, Varikuntapadu mandal, Nellore district. 2.
Counter affidavit is filed by the Tahsildar. It is averred in paragraph 4 that father of petitioner was assigned land to an extent of Ac.1.38 cents in Survey No. 88/2 and 4th respondent was also assigned land to an extent of Ac.1.50 in Survey No. 88/2 and there is confusion of allocation of land between the petitioner and 4th respondent, therefore they are quarrelling and on verification it was found that land of the petitioner is in sub-division No. 88/2 and land of 4th respondent is in sub-division No. 88/3. It is categorically asserted that Government is not taking or initiating any steps for dispossession of the writ petitioner and if there is any requirement of acquisition, due process would be followed. This statement of the Tahsildar/3rd respondent answers the grievance of the petitioner, therefore no further orders are required to be passed. 3.
At this stage, learned counsel representing 4th respondent submitted that still dispute exists regarding possession of land to an extent of Ac.0.34 cents. If 4th respondent has any grievance regarding the extent of land actually assigned to her, it is open to her to workout her remedies available under law. 4.
Accordingly, writ petition is disposed of. No costs. Having regard to the same, miscellaneous petitions, if any pending, are closed. ______________ P NAVEEN RAO,J DATE:1.8.2017
