THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY TRANSFER CRIMINAL PETITION No.265 of 2015 ORDER:

This transfer criminal petition is filed under Section 407 Cr.P.C., to withdraw D.V.C. No.60 of 2015 from the file of the court of Special Judicial Magistrate of First Class (Prohibition and Excise), Kurnool and transfer the same to the file of the court of Judicial Magistrate of First Class, Shadnagar, Mahabubnagar District.

2. The learned counsel for the petitioner seeks permission of this court to permit the petitioner to withdraw transfer criminal petition with liberty to avail all the remedies available to him under law. The learned counsel for the petitioner submitted that the petitioner/respondent in D.V.C., is suffering with ailment; therefore his presence before the trial court may be dispensed with.

3. Accordingly, this transfer criminal petition is dismissed as withdrawn granting liberty as prayed for. If the petitioner files petition under Section 205 Cr.P.C., the trial court is hereby directed to dispose of the same by taking into consideration the health condition of the petitioner.
