Heard learned counsel for the appellant.

Learned counsel for the appellant does not press the writ appeal and prays for observations that if a prosecution is launched against the appellant in view of the observations made in the impugned order, the Court concerned be directed to decide it on merits in accordance with law and uninfluenced by the observations made in the impugned order.

Appeal is disposed of as not pressed. It is needless to mention that if criminal offence is registered against the appellant on the basis of observations made in the impugned order, the Court concerned shall deal with the same on merits in accordance with law independently. No costs.

Consequently, miscellaneous petitions, if any pending, also stand disposed of.
