THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.45468 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the action of second respondent in issuing notice dated 09.12.2016 to the petitioner, as if he encroached the Gramakantakam poramboke land, as illegal and arbitrary. 2.

Heard the learned counsel for the petitioner, learned Government Pleader for Panchayat Raj, representing the first respondent, Sri G.Seshadri, learned standing counsel for Gram Panchayat, representing the second respondent and the learned Government Pleader for Revenue, representing the third respondent.

A perusal of the record reveals that the second respondent issued a notice to the petitioner on 09.12.2016 as if the petitioner encroached an extent of 16.5 sq. yards of land in Sy.No.58-2 (Door No.2-75/1) of Undavalli village, Tadepalli Mandal, Guntur District. The petitioner herein submitted his explanation to the said notice on 20.12.2016. For one reason or other, the second respondent did not pass any orders on the representation of the petitioner.

At the time of arguments, the only relief sought by the learned counsel for the petitioner is to direct the second

respondent to dispose of the representation of the petitioner dated 20.12.2016 as expeditiously as possible. 5.

In view of the submission made by both counsel, this Court is not inclined to express any opinion touching the merits of the main case.

Having regard to the facts and circumstances of the case, the second respondent is hereby directed to dispose of the representation of the petitioner dated 20.12.2016 as expeditiously as possible, in accordance with law. 7.

With the above direction, writ petition is disposed of. Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
