THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.35504 of 2015 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue.

The eviction notice is questioned in this Writ Petition primarily on the ground that there was no prior notice to the petitioner and no opportunity was given to him to submit his explanation. This Writ Petition is similar to the one considered by this Court in W.P.No.33628 of 2015, dated 12.10.2015.

In view of the same, following the aforesaid judgment, this Writ Petition is also allowed and the impugned notice is set aside. The competent authority shall, however, be at liberty to follow due process of law, if any action is intended to be taken against the petitioner. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in these Writ Petitions shall stand closed.
