HONOURABLE SRI JUSTI CE SANJAY KUMAR WRI T PETI TI ON No.10670 of 2019 ORDER:
The grievance of the petitioner is that Tahsildar, Maheswaram Mandal, Ranga Reddy District, is not taking steps to implement the order dated 30.03.2019 passed by the Joint Collector, Ranga Reddy District, in exercise of revisionary power under Section 9 of the Telangana Rights in Land and Pattadar Passbooks Act, 1971, (for brevity 'the Act of 1971'). By the said order, the Joint Collector, Ranga Reddy District, directed the Tahsildar, Maheswaram Mandal, to restore the entries in relation to the pattadar and possessor columns, as were existing in the year 1989-1990. The petitioner made a representation on 11.5.2019 to the Tahsildar, Maheswaram Mandal, seeking implementation of this order in so far as the restoration of the entries is concerned. His complaint is that despite receiving the said representation, the Tahsildar is not taking steps.
It is not open to the Tahsildar, Maheswaram Mandal, to ignore the revisionary order passed by the Joint Collector, Ranga Reddy district. It is not the case of the authorities that the said order has been suspended by a higher forum. That being so, the Tahsildar, Maheswaram Mandal, is bound to give effect to it.
The Writ Petition is accordingly disposed of directing the Tahsildar, Maheswaram Mandal, Ranga Reddy District, to give effect to the order dated 30.03.2019 passed by the Joint Collector, Ranga Reddy District, by duly acting upon the representation dated 11.05.2019 made by the petitioner. This exercise shall be completed expeditiously and in any
event, not later than two weeks from the date of receipt of a copy of this order, be it from whatever source.
Pending miscellaneous petitions in this Writ Petition, if any, shall stand closed. No order as to costs.
