THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No. 23110 of 2011 ORDER:

The petitioner complains against inaction of Respondents 1 to 4 in investigating the crimes registered in FIR Nos. 319 and 727 of 2011, as illegal and arbitrary.

The learned counsel for the petitioner fairly draws the attention of the Court to the additional counter-affidavit dated 16.04.2016 of Respondent No.4 and submits that since the investigation as thought fit by Respondents is completed, the inaction complained against the Respondents in conducting the investigation may not subsist for consideration as on date, but tries to point out that the 4th Respondent is under obligation to serve notice of filing final report under Section 173(2)(ii) of the Code of Criminal Procedure, 1973, and admittedly no such notice is served on the petitioner.

The objection is placed on record only to sensitize the 4th Respondent to act in accordance with law.

As the inaction complained against the investigation is substantially redressed, the writ petition is disposed of by accepting the submissions made in the additional counter affidavit dt. 16.04.2016 of the 4th Respondent. As a sequel, the

miscellaneous applications pending, if any, shall stand closed. There shall be no order as to costs.
