HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.39710 of 2016 ORDER:
1) Heard learned counsel for the petitioners and Government Pleader for revenue. With the consent of both the parties, the writ petition is taken up for disposal at the admission stage itself. 2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent Nos.2 to 4 in insisting the petitioners to vacate from their respective agricultural lands situated at Peddaganjam Revenue Villages in Chinaganjam Mandal, Prakasham District, without there being any authority and without following due process of law, as illegal, irregular and violative of Articles 14, 19 and 21 of the Constitution of India; and consequently direct them not to interfere with the petitioners in any manner.
3) The grievance of the petitioners is that though they were granted D-Form pattas and there are no violations of conditions of patta, the authorities are trying to dispossess them without following any procedure.
4) The Government Pleader for Revenue submits that no action will be taken without following due process of law. 5) Without going into the merits of the case and having regard to the submissions made, the writ petition is disposed of, directing the respondent authorities not to dispossess the
petitioners from the lands which are subject matter in this writ petition, if the petitioners are in possession, except following due process of law. There shall be no order as to costs. 6) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
