The petition coming on for hearing, upon perusing the Petition and the grounds filed in support thereof and upon hearing the arguments of Mis K. VENUMADHAV Advocate for the Petitioners and of Assistant PUBLIC PROSECUTOR for the Respondent, the Court made the following.

HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.4003 0F 2021 ORDER:

This Criminal Petition, under Section 438 of tht: Code of Criminal Procedure, 1973 (Cr.P.C.), is filed by the petitioners/A-l and A-2, for grant of anticipatory bail in Crime No.SO of 2027 of P.S. Anthargoan, Ramagundam, registered for the offence punishable under Section ilO6 read with Section 34 of the Indian Penal Code (IPC). Heard the learned counsel for the petitioners/A- 1 and A-2, the learned Assistant Public Prosecutor representing the respondent-State and perused the record.

Learned counsei for the petitioners/A-1 and A-2 would submit that the petitioners are innocent persons an d never committed any offence as alleged by the respondent-police. It is further submitted that the petitioners are law .abiding citizens and have nothing to do with the alleged offence. Further, they are ready to give sufficient sureties to the satisfaction of this Court to secure their presence on each and every date of hearing to lace the trial and also ready to abide by the terms and conditions if any that may be imposed by this Court for their release. Hence, he prayed to grant anticipatory bail to the petitioners/A-1 and A-2. Learned Assistant Public Prosecutor represent.ng the respondent-State opposed to grant anticipatory bail to the petitioners/A- I and A-2.

As seen from the material papers available on record, particularly the suicidal note, the deceased has stated nothing about the present petitioners and rather requested his father to help the petitioners for repayment of loans to the borrowers.

Having regard to the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioners/A- 1 and A-2 on some conditions.

Accordingly, the Criminal Petition is allowed and the petitioners/A-1 and A-2 xe granted anticipatory bail subject to the following terms and conditions:

(1) The petitioners/A-1 and A-2 are directed to surrender before the Station House Oflicer, P.S. Anthargoan, Ramagundam, u,ithin a period of 15 days from the date of this order. On such surrender, the said Statron House Officer shall release the petitioners/A- 1 and A-2 on bail, on their executing personal bond for a sum of Rs.25,000/- (Rupees twenty five thousand only) each with two sureties for a like sum each to his satisfaction

(2) The petitioners/A-1 and A-2 shall appear before the investigating authorities as and when required by them for the purpose of fair investigation.

(3) The petitioners/A-1 and A-2 sha11 abide bv the conditions stipulated in Section a3\e) C: .p .C and co-operate u,ith the investigating oilicer in investigating the case.

Miscellaneous applications, if any, pending shall stand closed.
