Heard learned counsel appearing for the petitioner and learned Government Pleader for Civil Supplies (A.P.).

Petitioner is the Dealer of Fair Price Shop No.34, Yerraobanapalli Village, Darsi Mandal, Prakasam District. Based on the report submitted by the Deputy Tahsildar alleging certain irregularities and variations in the stock at the time of inspection, the 2nd respondent issued show cause notice dated 17.03.2015, which was served on the petitioner, on 06.04.2015. The grievance of the petitioner is that without giving any time for submitting his explanation, and without conducting any enquiry, the 2nd respondent suspended his authorization, vide proceedings dated 06.04.2015.

Since the order challenged is an order of suspension pending enquiry, the Sub-Collector, Kandukuru, the 2nd respondent herein, is directed to conduct enquiry and pass final orders within a period of two (2) months from the date of receipt of a copy of this order, failing which, the authorization of the petitioner shall stand restored.

The writ petition is accordingly disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. ____________________ JUSTICE R.KANTHA RAO 30th April, 2015 GJ
