THE HON'BLE SRI JUSTICE M. GANGA RAO WRIT PETITION No.14180 of 2002 O R D E R:
The petitioner, Technician (Operations) in the Visakhapatnam Steel Plant filed this writ petition being aggrieved by the proceedings Ref.No.WK/BF/107102/2002/687 dated 23.7.2002, wherein the petitioner was suspended on the ground that Cr.No.52 of 2002 under Section 498-A and 306 I.P.C., Kothavalasa Police Station, Vizianagaram District was registered, as illegal and arbitrary.` The case of the petitioner is that while he was working as Technician (Operations) under the respondent-Steel Plant, vide impugned memo dated 23.7.2002 passed in Ref.No.WK/BF/107102/2002/687 he was placed under suspension for his involvement in Crime No.52 of 2002 under Section 498-A and 306 IPC of Kothavalasa Police Station. The petitioner further submits that he was falsely implicated in the case and the same is not connected with the discharge of his official duties.
Subsequently, the petitioner submitted a representation to revoke the suspension order. The respondentSteel Plant while revoking the order of suspension with immediate effect vide proceedings No.WK/BF/REVOKE/2011 dated 2.4.2011 stated that the petitioner is entitled for payment of salary and other benefits equivalent to as per clause no.(ii) vide Circular No.PL/RR/I(1)/2000 dated 16.11.2000 (PP.Cir.No.12/2000) from the date of issue of the said order, by withdrawing the payment of
subsistence allowance and that a separate pay fixation order will be issued, without prejudice to the rights of the "Rashtriya Isapat Nigam Limited, Visakhapatnam Steel Plant" to initiate any disciplinary action and recover the damages, if any, if the petitioner is convicted, without any prior notice At present, it is not known what action is taken by the Steel Plant. In the circumstances, it is left open to the petitioner as well as respondent-Steel Plant to take appropriate action to settle the salary and other benefits to the petitioner, as per law.
