Heard the learned counsel for the petitioner and the learned Government Pleader for Prohibition and Excise for the respondents and at their request, the matter is taken up for disposal at the stage of admission. This writ petition is filed for a writ of Mandamus declaring the action of the 5th respondent - the superintendent, office of Prohibition and Excise Superintendent, Adilabad, in issuing orders in Rc.No.A5/79/2016 dated 6.6.2016 seeking suspension of licenses bearing No.4, which is valid upto 30.9.2017 in respect of the toddy Depot Mudhole Village and Mandal, Bhainsa Adilabad District, as illegal and unconstitutional and contrary to the principles of natural justice.
A perusal of the impugned order goes to show that it is only a show cause notice, pointing out certain irregularities requiring the petitioner to submit his explanation. As per the writ averments, the petitioner has submitted his reply to the show cause notice on 13.6.2016. In view of the same, without going into the merits of the case, the writ petition is disposed of directing the 5th respondent - Superintendent, to consider the explanation submitted by the petitioner and pass appropriate orders, in accordance with law, if not already passed, within a period of two weeks from the date of receipt of a copy of this order, after hearing the petitioner. No costs.
