This appeal is directed by the insurance company against the judgment and decree dated 05.06.2006 passed by the Motor Accidents Claims Tribunal-cum-V Additional District Judge (FTC), R.R. District at L.B.Nagar (for short 'the Tribunal), in O.P.No.183 of 2005, whereby the tribunal partly allowed the petition granting compensation of Rs.46,000/- with interest at 7.5% per annum from the date of petition till the date of realization against both the respondents jointly and severally, as against the claim of Rs.1,25,000/-. 2.
On perusal of the entire material available on record and having regard to the facts and circumstances of the case, on the strength of the evidence of PWs.1 and 2 and Exs.A1 to A5 and Exs.B.1 and B.2, the tribunal rightly granted compensation and hence, the judgment passed by the tribunal is well considered and needs no interference of this Court. Accordingly, the appeal filed by the insurance is liable to be dismissed.

In view of the above, the appeal is dismissed confirming the judgment and decree dated 05.06.2006 in O.P.No.183 of 2005 passed by the Motor Accidents Claims Tribunal-cum-V
Additional District Judge (FTC), R.R. District at L.B.Nagar. There shall be no order as to costs.
