HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL REVISION CASE No.772 of 2018 ORDER:

Heard the learned counsel for the petitioner and perused the order impugned.

This Criminal Revision Case is disposed of at the admission stage as this court finds no reason to issue notice to the respondents. This Criminal Revision Case is filed by the petitioner/accused aggrieved by the docket order dated 23-2-2018 whereunder in an elaborate order explaining how many adjournments have been taken by the learned counsel for the petitioner/accused to cross-examine the respondent/complainant on different dates, the Court ultimately observed that the matter would be posted to 23-2-2018 on which date, learned counsel for the petitioner/accused will be given an opportunity soon after the call work till rising of the day if necessary. Heard the learned counsel for the petitioner. His submission is that the respondent/complainant filed twenty nine documents and they were marked as Exhibits and it may not be possible to complete the entire cross-examination within the time limit fixed by the trial court.

The docket order reads that P.W.1 was already crossexamined at length on 17-1-2017, 21-1-2017, 1-2-2017, 18-3-2017, 15-4-2017, 11-8-2017 and 5-1-2018, 2-2-2018, 15-2-2018 and finally on 23-2-2018 on which dates, the order impugned was passed finally.

UDPR,J Crlrc_772_2018 In that view of the matter, if the petitioner/accused cannot articulate his questions precisely and complete his crossexamination in the entire day on 23-2-2018, no Court can help him. It should be reminded that not only present case, the trial Court has to dispose of the other matters including the old matters also. I find no illegality or perversity in the order impugned. Accordingly, this Criminal Revision Case is dismissed. As a sequel, miscellaneous applications pending if any, shall stand closed.
