Heard the learned counsel for petitioners, learned Government Pleader for Municipal Administration appearing for 1st respondent, Sri S. Lakshmi Narayana Reddy, learned Standing Counsel for 2nd respondent and Sri P.Jagadishchandra Prasad, learned Standing counsel for 3rd respondent.

Petitioners' grievance is that petitioners had preferred an appeal dt.11-07-2016 to the appellate authority constituted under Rule 11 of the Andhra Pradesh Regulation and Penalization of Unauthorisedly constructed buildings and buildings constructed in deviation of the Sanctioned Plan Rules, 2007 (For short "the Rules"); that though the appellate authority is functioning from 13-05-2014, but the appeal is not being disposed of by the said appellate authority. 3.

Learned Government Pleader for Municipal Administration appearing for 1st respondent states that the appellate authority under the Rules will dispose of the said appeal within two (02) months from the date of receipt of copy of the order and communicate his decision to the petitioners after complying with the principles of natural justice. 4.

In view of the said submission, the Writ Petition is disposed of directing the appellate authority under the Rules to dispose of petitioners' appeal dt.11-07-2016 within two (02) months from the

MSR,J W.P.No.9452 of 2018 date of receipt of copy of the order and communicate his decision to the petitioners after complying with principles of natural justice. Till the said appeal is disposed of, the respondents shall not levy penalty amount over the municipal taxes being collected in respect of Assessment numbers set out in Annexure-I to the Writ Petition. No costs.

As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
