THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.9221 of 2015 ORDER:

Heard the learned counsel for petitioner and the learned Government Pleader for Civil Supplies for respondents.

2. The petitioner was appointed as a fair price shop dealer of shop No.31 of Pulikonda Village, H/o. Pandikona, Pattikonda Mandal, Kurnool District. While so, the third respondent submitted a report to the second respondent on 05.03.2015 informing that the Mandal Revenue Inspector, Pattikonda inspected the shop and found some variation in the quantities of stock. No enquiry was conducted and the impugned order dated 18.03.2015 was passed canceling the authorization of the petitioner. Challenging the same, the present Writ Petition is filed.

3. This Court perused the order dated 18.03.2015 and it is clear from the order that the report of the third respondent was taken into consideration and the authorization of the petitioner was accordingly cancelled. A perusal of the order does not indicate issuance of show cause notice or conduct of enquiry.

4. In the circumstances, the impugned order dated 18.03.2015 of the second respondent, is set aside and the Writ Petition is allowed. However, this will not prevent the second respondent from conducting an enquiry in respect of the allegations against the petitioner in accordance with law, if he so chooses. No order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
