ORDER:- Heard.

2. Petitioner questions the impugned notice dated 30.07.2015 on the ground that the Mandal Revenue Inspector, third respondent, has no power to issue any such notice under the WALTA.

3. The said contention is clearly tenable as any action intended to be taken under the said Act is required to be taken by the fourth respondent and not by the third respondent.

4. Learned government pleader also does not dispute the said position in law.

5. Hence, the impugned notice is quashed. However, the fourth respondent is at liberty to take appropriate action, if warranted on the facts of the case, after due following the provisions prescribed under Section 15 of the WALTA.

The writ petition is allowed. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs. _____________________ VILAS V. AFZULPURKAR, J September 21, 2015 LMV
