HON'BLE SRI JUSTICE A.RAJASHEKER REDDY AND HON'BLE SRI JUSTICE M.LAXMAN IA.Nos.1 & 2 OF 2022 AND FCA.Nos.56 & 57 OF 2020 COMMON JUDGMENT:(per Hon'ble Sri Justice A.Rajasheker Reddy) Both these appeals are filed by the appellant/husband against the common order dt.01.02.2020 passed by the Judge, Addl.Family Court, Hyderabad in FCOP.Nos.970 of 2017 & 73 of 2017 (first one is filed by the husband seeking dissolution of marriage and second one is filed by the wife for restitution of conjugal rights), wherein and whereby the Court below dismissed FCOP.No.970 of 2017, filed by the husband for dissolution of marriage and allowed FCOP.No.73 of 2017 filed by the wife for restitution of conjugal rights, directing the husband/petitioner in FCOP.970/2017 to take back his wife to his company.

During the pendency of these appeals, the appellant/husband and the respondent/wife have amicably compromised the matter and are ready to take mutual divorce in terms of compromise. Accordingly, I.A.Nos.1 & 2 of 2022 were filed by the petitioner/husband seeking permission to compromise the matter and to record the compromise by granting decree of divorce by dissolving the marriage between them. The petitioner/husband had filed memo of compromise along with IA.No.2 of 2022 stating that they have amicably compromised the matter. Heard learned counsel for the appellant/husband as well as learned counsel for respondent/wife.

The appellant and respondent are present in person through virtual mode and they are identified by their respective counsel. The respondent/wife admitted the terms of compromise and stated that she is agreeable for divorce and has received an amount of Rs.10,00,000/- by way of DD No.787148, dt.27.01.2022 and Rs.2,00,000/- by way of cash, towards full and final settlement against all the claims.

In view of the above, the Compromise entered into between the parties is hereby recorded and IA.Nos.1 and 2 of 2022 are ordered. A decree be drawn in accordance with the terms of Compromise and a copy of Memo of Compromise filed by the petitioner/husband shall form part of the record. Accordingly, both the appeals are allowed in terms of Compromise entered into between the parties and the order dated 01.02.2020 passed in FCOP.Nos.970 of 2017 and FCOP.No.73 of 2017 by the Judge, Addl.Family Court, Hyderabad, is set aside granting divorce to the parties by mutual consent. Miscellaneous petitions, if any, pending in the FCAs shall stand dismissed.
