THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.8743 of 2018 ORDER:
This Writ Petition is filed challenging the order passed by the second respondent on 02.09.2017 remanding the matter to the fourth respondent for disposal of the application of the fifth respondent for mutation of her name in respect of the land of an extent of Ac.0.30 guntas in Survey No.5 of Hydlapur Village of Miryalaguda Mandal, Nalgonda District.
In view of the nature of disposal of the present Writ Petition, the notice to the fifth respondent is dispensed with. It appears that the petitioner preferred an appeal before the Revenue Divisional Officer against the entries made by the fourth respondent in respect of the above land which was assigned by the authorities in favour of the petitioner. When the Revenue Divisional Officer passed an order on 08.06.2012, the fifth respondent preferred a revision before the second respondent. The second respondent passed the above order of remand on 02.09.2017. The second respondent noticed certain procedural irregularities in the order passed by the third respondent and also held that the third respondent is not having jurisdiction to decide the dispute. In view of the same, this Court does not find anything wrong in the order passed by the second respondent. However, since the matter is remanded to the fourth respondent, learned Counsel for the petitioner
submits that the entries in the revenue records shall not be disturbed in the meanwhile.
Accordingly, the Writ Petition is disposed of directing the fourth respondent to dispose of the matter arising between the petitioner and the fifth respondent remanded by the second respondent by virtue of the order dated 02.09.2017, as expeditiously as possible, but not later than two months from the date of receipt of a copy of this order. In the meanwhile, there shall be status quo with regard to the entries in the revenue records. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
