Requesting for grant of regular bail under Sections 437 and 439 of the Code of Criminal Procedure, 1973, the present petition is filed by accused No.3 in Crime No.65 of 2016 of Chinturu Police Station, East Godavari District.
The petitioner alleged to have committed the offence punishable under Section 8 (c) read 20 (b) (ii) (c) of the Narcotic Drugs and Psychotropic Substances Act.
Heard Sri S.Surender Reddy, learned counsel for the petitioner, and the learned Additional Public Prosecutor for the State of Andhra Pradesh.
Learned counsel for the petitioner mainly rests on one circumstance that being the petitioner has been in judicial remand for the past nine months, having been remanded to judicial custody on 06.10.2016.
The quantity of ganja seized from the possession of the accused persons is 132 kgs and, as such, comes within commercial quantity. However, learned counsel for the petitioner, ultimately, makes a request to direct the trial Court to dispose of the main case itself by fixing a time frame.
The last request made by the learned counsel for the petitioner appears to be reasonable, keeping in view, the fact that the petitioner has been in judicial remand for the past nine months. Hence, the Criminal Petition is dismissed. However, the I-Additional Sessions Judge, Rajahmundry, is directed to dispose of NDPS Sessions Case No.36 of 2017 as expeditiously as possible, not later than eight months from the date of receipt of a copy of this order. _________________________ A.SHANKAR NARAYANA,J 12.07.2017 Note: Issue CC in three days B/o v v
