Counsel for the petitioners: Sri Kothapalli Ram Mohan Chowdary Counsel for the respondents: AGP for Civil Supplies (AP) The Court made the following:
ORDER:
This writ petition is filed for a mandamus to set aside show-cause notice bearing Rc.No.K3/ATP/580/2009, dated 01.12.2009, of respondent No.2 and the consequential proceedings in Rc.No.K3/580/2009, dated 10.02.2012, of respondent No.1, directing interim disposal of the seized stock. At the hearing, Sri Kothapalli Ram Mohan Chowdary, learned counsel for the
petitioners, submitted that in the absence of any interim order granted by this Court, the seized stocks were disposed of pending the proceedings under Section 6-A of the Essential Commodities Act, 1955 (for short 'the Act') and that subsequently, the proceedings under Section 6-A of the Act were concluded by directing confiscation of 2% of the value of the seized stocks sold and refund of the balance amount. In the light of the above subsequent events, the cause in the writ petition does not survive for adjudication.
The writ petition is accordingly dismissed as infructuous. As a sequel to dismissal of the writ petition, W.P.M.P.Nos.12550 and 12551 of 2012 shall stand disposed of as infructuous. C.V.NAGARJUNA REDDY, J 29th July, 2015 VGB
