THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2288 OF 2016 ORDER:

This petition is filed by the petitioner-A5 under Section 482 Cr.P.C. seeking to quash the proceedings against him in Crime No.378 of 2015 on the file of II Town Police Station, Nalgonda, Nalgonda District, registered for the offence punishable under Section 306 r/w 34 IPC.

The allegation against the petitioner is that he gave an amount of Rs.29 lakhs to the deceased and the deceased repaid Rs.17 lakhs and the petitioner harassed the deceased by demanding the remaining amount. The petitioner and other accused, who lent the amount to the deceased, harassed him and damaged his dignity and therefore, the deceased committed suicide.

Considering the facts and circumstances of the case, this Court is not inclined to grant the relief sought by the petitioner. At this stage, the learned Counsel for the petitioner submitted that due to the pendency of the above crime, the petitioner apprehends arrest and harassment in the hands of the 1st respondent-police. In view of the above submission, the 1st respondent-police are directed to complete the investigation and file the charge sheet, if any, without arresting the petitioner. The petitioner is also directed to appear before the investigating agency as and when required for the purpose of investigation.

With the above direction, the Criminal Petition is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed.
