02.02.2022 LK,J I.A.No.1 of 2022 The present petition is filed seeking relaxation of the conditions imposed by this Court, by order dated 28.06.2021, whereby the condition No.(ii) was imposed directing the petitioners to appear before the Investigating Officer on 1st Saturday of every month between 10.00 a.m. and 12.00 Noon, till filing of the charge sheet and they shall cooperate with the investigation.

Learned counsel for the petitioners submits that the petitioners have been complied with the conditions imposed in Crl.P.No.4012 of 2021 from June, 2021 onwards. As such, condition No.(ii) may be relaxed.

Learned Assistant Public Prosecutor, on instructions, submits that the petitioners are appearing before the police and investigation is pending.

Taking into consideration the fact that the petitioners are appearing before the Police from 18.06.2021, this Court deems it appropriate to modify the said condition to the extent of "the petitioners shall appear before the Investigating Officer, as and when his presence is required. Further, respondent police shall give an advance notice to the petitioners in this regard".

Accordingly, this application is ordered.
