CVNR, J CRP Nos.163 & 164/2017 COMMON ORDER:

These two civil revision petitions arise out of separate orders dt.22.11.2016 passed by the lower Court in I.A. Nos.563 and 562 of 2016 respectively in O.S. No.58 of 2016.

The petitioner, who filed the above mentioned suit, filed I.A. Nos.563 of 2016 for amendment of the pleadings as well as the prayer in order to seek restoration of electricity supply released in favour of the original defendants by proposed defendant No.6. I.A. No.562 of 2016 was filed to implead the proposed defendant No.6. Both these applications were dismissed by the lower Court by separate orders. After arguing the case, Mr. P. Shashi Kiran, learned counsel for the petitioner, realizing that his client has not sought appropriate amendment regarding the prayer, in that, mutation in favour of the defendants, following which proposed defendant No.6 released electricity connection in their favour, was not questioned, he requested the Court to give liberty to his client to file fresh applications seeking appropriate reliefs.

The request of the learned counsel is accordingly accepted and the Civil Revision Petitions are dismissed with liberty to the petitioner in terms of the prayer made. The orders under these two revisions shall not come in the way of the petitioner to file fresh applications for appropriate reliefs. As a sequel to dismissal of the civil revisions petitions, C.R.P.M.P. Nos.199 and 200 of 2017 filed in the respective revision petitions shall stand disposed of as infructuous.
