HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.189 of 2016 ORDER:

This application is filed to withdraw O.P. No.255 of 2014 from the file of Family Court, Ranga Reddy District and transfer the same to Family Court, Warangal.

2. Wife filed this petition. According to her affidavit, her marriage with respondent was performed on 01.03.2012 at D.M.R.Gardens, Uppal, Ranga Reddy District, as per Hindu Custom and Rites. She stated that after marriage she joined respondent and they blessed with a male child, thereafter respondent and his parents started harassing her both physically and mentally, therefore, she is staying with her parents and the efforts of caste elders and relatives for settlement have not yielded any results. She stated that respondent filed O.P. No.255 of 2014 for restitution of conjugal rights before Family Court, Ranga Reddy District and that she filed M.C No.104 of 2014 before Family Court, Warangal.

She stated that she is dependant on her parents and her father is an agriculturist and it is difficult for her from Warangal to Ranga Reddy District. She further stated that she is apprehending danger to her life at Ranga Reddy District. She further stated that there is none to accompany her from Warangal to Ranga Reddy District, therefore she prayed for transfer of O.

Court, Warangal.

3. Respondent in spite of granting four adjournments did not choose to file any counter disputing the affidavit averments of petitioner.

4. Today when the matter is taken up for hearing, neither advocate for respondent is present nor any representation is made on his behalf.

5. It is represented on behalf of petitioner that respondent is attending Family Court, Warangal in connection of M.C filed by the wife and no prejudice will be caused if this O.P. is transferred to Warangal.

6. Considering the reasons stated in the affidavit filed in support of the petition and also considering the convenience of wife and the fact that respondent is already attending Family Court, Warangal in connection of M.C. No.104 of 2014 request of wife for transfer of O.P. from Ranga Reddy District to Warangal, is considered.

7. Accordingly, O.P. No.255 of 2014 is withdrawn from the file of Family Court, Ranga Reddy District and transferred to Family Court, Warangal for disposal in accordance with law.

8. Transfer Petition is ordered. No costs.

9. Miscellaneous Petitions, if any, shall stand dismissed.
