Heard the learned Counsel for the petitioner and the learned Government Pleader for the respondents.

This Writ Petition was filed challenging the action of the third respondent in not appointing the petitioner as a permanent fair price shop dealer of Shop No.34, Rangasamudram Village, Pedda Thippa Samudram Mandal in Chittoor District, pursuant to G.O.Ms.No.4, dated 28.02.2014.

Notice before admission was ordered on 01.06.2015 and the learned Government Pleader was directed to obtain instructions. Now the learned Government Pleader got written instructions, which states that the Sub Collector, Madanapalle, who is the appointing authority, had examined the connected records and after due enquiry issued endorsement in Roc.No.A3/431/2015, dated 04.04.2015, observing that the fair price shop dealer, who is deceased, was not having any family members, and hence the application made by the petitioner could not be considered. In view of the above, the Writ Petition is dismissed, but giving liberty to the petitioner to challenge the proceedings dated 04.04.2015. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
