Heard learned counsel for the petitioner and learned Additional Public Prosecutor representing the State of Andhra Pradesh.
This criminal petition is filed under Section 482 of Cr.P.C to quash the order dated 18.10.2016 passed in C.R.P.No.70 of 2016 by the III Additional District and Sessions Judge, Nellore, confirming the order dated 23.08.2016 passed in Cr.M.P.No.1271 of 2016 in Crime No.58 of 2016 by the Judicial Magistrate of First Class, Atmakur on the ground that the Divisional Forest Officer alone is competent to release the vehicle under Section 44 of the A.P. Forest Act, 1967. During the course of hearing, Sri, G.Venkateswarlu, learned counsel for the petitioner requested the Court to pass appropriate orders directing the Divisional Forest Officer for release of the vehicle.
Acceding the request made by the learned counsel for the petitioner, without adverting to the merits of the case, I deem it appropriate to permit the petitioner to approach the Divisional Forest Officer for release of the vehicle and on filing the application by the petitioner before the Divisional Forest Officer, he is directed to pass appropriate orders in accordance with law within a period of 15 days thereof.
With the above observations, the criminal petition is disposed of.
Pending miscellaneous petitions in the petition, if any, shall stand closed.
