THE HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO CONTEMPT CASE NO. 1609 OF 2017 ORDER:

This Contempt Case is filed alleging non implementation of the order in Writ Petition No.18075 of 2016 dated 6.3.2017. The said Writ Petition was filed challenging the action of the 2nd respondent, Station House Office, Jagathgirigutta Police Station, Cyberabad, in not registering the complaint dated 2.3.2016.

This Court noticed that the issue raised by the petitioner comes within the jurisdiction of the District Educational Officer, Medchal and accordingly, gave liberty to the petitioner to submit a representation to the District Educational Officer, Medchal, for taking necessary action.

Now a counter affidavit is filed by the District Educational Officer stating that the representation of the petitioner was received on 27.3.2017 and after receiving the said representation, proceedings were issued on 7.4.2017 to the management of Chaitanya Vidya Niketan, High School, Jagatgirigutta, Qutubullapur Mandal, to submit explanation for producing forged sanitary certificate within seven days. In response to the same, the Correspondent submitted a letter dated 12.9.2017 stating that he obtained a Sanitary Certificate

in the year 2009 from the Municipality in original and did not enclose any fake certificate and also enclosed Sanitary Certificates dated 14.6.2016 and 11.9.2017 along with the originals.

The District Educational Officer further stated that the management has not violated the rules and the school is running without violating any conditions and no action can be initiated against the school.

In view of the said averments in the counter affidavit filed in the present Contempt Case, no further action is warranted in the present Contempt Case and the Contempt Case is closed. However, this order will not prevent the petitioner from taking appropriate proceedings in accordance with law, if he is aggrieved.

Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
