THE HONOURABLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.10689 of 2019 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Cooperation.

Admittedly, the petitioner has alternate remedy of appeal under Section 76 of the Telangana Cooperative Societies Act, 1964 (for short, 'the Act').

Learned counsel for the petitioner submits that since no notice is issued to the petitioner, the impugned order is passed in violation of principle of natural justice.

Learned Government for Cooperation filed counter affidavit stating that notices were sought to be served on the petitioner on the last known address, but the same were returned as addressee was absent.

In view of the facts and circumstances, as the petitioner has alternate efficacious remedy of appeal under Section 76 of the Act, this Court is not inclined to entertain the writ petition. Accordingly, the writ petition is dismissed granting liberty to the petitioner to avail alternate remedy of appeal. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
