HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.11082 of 2015 ORDER:

Heard the learned counsel appearing for the petitioner and the Government Pleader for the Civil Supplies (TS).

2. This writ petition is filed seeking writ of Mandamus declaring the action of the respondents 3 and 4 in not appointing the petitioner as fair price shop No.13 dealer of Lingampally Village, Manchal Mandal, Ranga Reddy District, as illegal and arbitrary.

3. The father of the petitioner was the permanent fair price shop dealer for shop No.13, Lingampally Village. While working as a dealer, he expired on 17.06.2014. Thereafter, the petitioner made a representation to the 5th respondent/Mandal Revenue Inspector, who visited the Village and after enquiry, submitted a report to the 4th respondent on 22.07.2014, stating that the petitioner is eligible for appointment as fair price shop dealer in the place of his deceased father on compassionate grounds. Basing on the report of the 5th respondent, the 4th respondent-Tahsildar also submitted a report to the 3rd respondent on 30.07.2014 recommending the name of the petitioner to appoint him as a fair price shop dealer in the place of his deceased father. The grievance of the petitioner is that respondents 3 and 4 have not taken any action on his representation for appointment as fair price shop dealer on compassionate grounds as per G.O.Ms.No.4 dated 28.02.2014.

4. Under these circumstances the respondents are directed to consider the case of the petitioner for appointment as fair price shop dealer for Shop No.13, Lingampally Village, Manchal Mandal, Ranga Reddy District, in terms of G.O.Ms.No.4 dated 28.02.2014 on

compassionate grounds, subject to his eligibility.

5. The writ petition is accordingly disposed of. Miscellaneous applications, if any, shall stand closed.

No order as to costs.
