ORDER

This petition under Section 482 Cr.P.C. is filed by the petitioner/A3 seeking to modify the order dated 24.02.2016 passed in Crl.M.P.No.503 of 2016 in C.C.No.359 of 2014 on the file of Additional District and Sessions Judge, Anakapalle.

2. The petitioner herein is A3 in C.C.No.359 of 2014 on the file of Additional District and Sessions Judge, Anakapalle, registered for the offence punishable under Section 7 of Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954. She filed the impugned application to recall the NBW pending against her. By the order impugned, the Court below while recalling NBW, directed the petitioner to execute a bond for a sum of Rs.10,000/-with two sureties for a like sum each on or before 10.06.2016. It is now submitted by the petitioner that as her condition is very critical, she was admitted in hospital and now she is in ICU and is not in a position to move from the bed.

3. Learned counsel for the petitioner submits that as the petitioner is unable to move from the bed, time granted by the trial Court for furnishing the sureties may be extended.

Considering the facts and circumstances of the case and in view of the health condition of the petitioner/A3, time for submission of sureties given by the Court below is extended till 10.09.2016. 5.

Subject to the aforesaid condition, the Criminal Petition is disposed of. Miscellaneous applications, if any, pending in this petition shall stand closed.
