THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.1834 of 2004 ORDER:

The writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the action of the first respondent in not allowing the petitioners to appear for written test/interview for selection and appointment to the post of Watchman as illegal, arbitrary and contrary to the Judgment of the Hon'ble Supreme Court of India reported in 1996(6) Scale in Excise Superintendent, Malakapatnam, Krishna District Vs. K.B.N.Visweswara Rao and consequently to direct the respondents to consider their case for selection and appointment to the post of Watchman without insisting that their names should be sponsored by the Employment Exchange and to pass such other necessary orders. Heard the learned counsel for the petitioners and Smt.G.Jhansi, learned standing counsel appearing for the respondents.

At the time of hearing, both counsels with one voice submitted that no further orders are necessary in this writ petition in view of the interim orders of this Court dated 30.01.2004 and the writ petition has become infructuous. In view of the submission made by both the counsel, the writ petition is dismissed as infructuous.
