THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.6070 of 2016 ORDER:
This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash proceedings initiated against the petitioners/A-5 to A-13 in Crime No.34 of 2016 of Women Police Station, Warangal, registered for the offences punishable under Sections 498 A, 307, 342, 420, 506 and 201 IPC and Sections 3 and 4 of Dowry Prohibition Act.
Heard the learned counsel for the petitioners/A-5 to A-13 and the learned Public Prosecutor and perused the material on record.
The main grounds raised by the learned counsel for the petitioners/A-5 to A-13 are that there are no serious allegations against the petitioners; the petitioners/accused are neither family members nor related to husband of the second respondent/de facto complainant in which case no ingredients of Section 498 A IPC are attracted, as the ingredients of that section would attract only to the members of the family.
Having regard to the facts and circumstances of the case, without expressing any opinion on the merits of the case, this Court is of the view that all these facts can be properly adjudicated by the investigating agency, who will take appropriate decision thereafter as per law. However, since it is stated that the matter is under investigation, the police concerned are directed to complete the investigation without arresting the petitioners and file final report in accordance with law. However, it is made clear that the petitioners herein are always at liberty to approach this Court if
they aggrieved by the final report that may be filed by the investigating agency.
Accordingly, the Criminal Petition is disposed of.
Consequently, miscellaneous petitions, if any, pending, shall stand closed.
