HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2962 of 2016 ORDER:
This Criminal Petition, under Section 482 Cr.P.C., is filed by the petitioners-accused Nos.1 to 3 seeking to quash the order, dated 29.10.2015 in PRC No.19 of 2015 on the file of Additional Judicial Magistrate of First Class, Sanga Reddy at Medak. The offences alleged against the petitioners are punishable under Sections 498-A IPC and 3 & 4 of the Dowry Prohibition Act. Admittedly, after duly investigating into the case, the police filed charge sheet against the petitioners. Hence, this Court is not inclined to interfere with the proceedings against the petitioners. It is submitted by the learned counsel for the petitioners that the learned Magistrate issued N.B.W. against petitioners while taking cognizance of the above said offences and that the petitioners are ready to face the trial and they will not flee from the hands of justice.
Having heard the learned counsel for the petitioners and the learned Additional Public Prosecutor and having perused the material available on record, this Court is of the view that this criminal petition can be disposed of with the following directions: The petitioners-accused Nos.1 to 3 are directed to appear before the Court concerned and file a petition to recall the warrants issued against them and on such petition being filed, the trial Court is directed to recall the warrants on the same day on petitioners his executing personal bond for a sum of Rs.5,000/- (Rupees five thousand only) each with one surety for a like sum each and further the petitioners are directed to appear before the trial Court on all hearing dates.
Accordingly, the Criminal Petition is disposed of.
Consequently, the Miscellaneous Petitions pending if any, shall stand closed.
