Respondent/Complainant (Respondents in-do-) Petition under Section 482 of Cr.P.C praying that in the circumstances stated in the petition, the High Court may be pleased to realx the condition imposed in Crl.P.No. 4032 of 2021 dt. 03/06/2021 by deleting the condition (ii) "The petitioner shall personally appear before the Inspector of Police, C.B.L, A.C.B., Hyderabad on Saturday between 12.00 Noon and 5.00 pm, till completion of the investigation", CRLP NO: 4032OF 2O2L Petition under Sections 437 & 439 of Cr.P.C, praying that in the circumstances stated in the petition and the grounds filed therein, the High Court may be pleased to enlarge the petitioner on bail pending trial of the case arising out of FIR No. RC 10(A)/2019 of CBI, ACB, Hyderabad, dated 08,09.
2019; The petition coming on for hearing, upon perusing the Petition and the grounds filed in support thereof and the order of the High Court dated 03.06.2021 made in Crl.P,, and upon hearing the arguments of Sri T.S.Anirudh Reddy Advocate for the Petitioner and of Sri K.
ORDER
This application is filed seeking relaxation of condition imposed in Crl.P.No.4O32 ol 2O2L, dated 03.06.2O2L, by deleting the condition No.(ii) of 'the petitioner shall personally appear before the Inspector of Police, C.B.I., A.C.B,, Hyderabad, on every Saturday between 12.00 Noon and 5.00 p.m., till completion of the investigation'.
Mr.T.S.Anirudh Reddy, learned counsel for the petitioner, submits that petitioner has been complying with the order dated 03.06.2021 passed by this Court in Crl.P,No.4O32 oi 2021, He submits that as the crime is of the year 2019 and petitioner is a Centrat Government employee working in G.S.T. Department, it is difficult for him to comply the said condition. The petitioner is ready to cooperate with the investigation, as such, the said condition may be relaxed.
On the other hand, Mr.K.Surender, learned Special Public Prosecutor for.CBI cases, do not dispute the fact that petitioner has been complying with the conditions imposed by this Court in Crl,P.No.4032 ol 2O2L. He submits that there are several issues involved in this case and the investigation is yet to be completed, as such, the condition shall be intact.
Taking into consideration the fact that the petitioner has been complying the order of this Court from 03.06.2021, the crime is of the year 2O19 and petitioner is a central government employee, this Court deems it appropriate to modify condition No.(ii) to the extent ol "Petitioner shall personally appear before the Inspector of Police, C.B.L, A.C.B., Hyderabad, as and when required for the purpose of investigation, Further, the police shall give an advance notice to the petitioner in this regard," Accordingly, this application as allowed //IRUE COPY// ^33/#^i+H,tIHl.
