Heard Sri G.Vasantha Rayudu for petitioner, Sri K.Raghu Babu for 2nd respondent and learned Government Pleader (Civil Supplies) for respondents 1 and 3.
Petitioner complains against non-allotment of paddy for Custom Milling Rice (CMR) for the Kharif season 2016-17 as arbitrary, illegal and without jurisdiction.
Petitioner admittedly faced proceedings under Section 6-A of the Essential Commodities Act, 1955.
I have perused the written instructions placed on record by the learned Government Pleader for respondents 1 and 3. After perusing the instructions, this Court is of the view that the effort of petitioner to get appropriate relief by filing the writ petition is not tenable. The petitioner, if so, advised is given liberty to re-submit the representation to respondent No.3 along with the copy of this order within one week from today for allotment of paddy for Custom Milling Rice and on such representation, being filed, respondent No.3 is directed to consider and communicate his decision to the petitioner within a further period of two (2) weeks from the date of representation. With the above direction, the Writ Petition is disposed of. As a sequel, the miscellaneous petitions, if any pending, shall stand closed. There shall be no order as to costs.
