Respondents (Respondents in-do-) Petition under Section 397(1) of Cr.P.C., praying that in the circumstances stated in the petition, the High Court may be pleased to suspend the execution of sentences passed in CC.No. 201 of 2011 dt. 20-08-2015 of Judl. Magistrate of First Class, Spl. I\4obile Court, Nellore as confirmed by the lll Addl. Sessions Judge,Nellore in Crl.A.No. 28312015 dt. 9-1 1-2018 and release the petitioner on bail, pending disposal of Crl.RC. 3389/2018 on the file of the High Court.

The petition coming on for hearing, upon perusing the petition and the grounds filed in Crl.R.C., and upon hearing the arguments of Sri G.Vijaya Saradhi, Advocate for the Petitioner and of Public Prosecutor (AP) for the Respondent No.1, the Court made the following ORDER:

" This application is filed under Section 397(1) Cr.P.C. seeking for suspension of sentence passed in C.C.No. 2O'l of 2011, dated 20.08.2015 by the Judicial Magistrate of First Class, Special Mobile Court, Nellore and confirmed by lll Additional Sessions Judge, Nellore, vide judgment dated 09.11.2018 and for release of the petitioner on bail.

Heard the learned counsel for the petitioner. ln view of the grounds urged in the Revision Case, the sentence of imprisonment for six months and payment of compensation of Rs.3,00 lakhs imposed against the petitioner are suspended on his depositing 1/4th of the compensation, and the petitioner shall surrender before the trial Court, and on such surrender, he shall be released on bail on executing self bond for a sum of Rs.10,0001 (Rupees Ten Thousand Only) with two sureties for a like sum each to the satisfaction of the Judicial Magistrate of First Class, Special Mobile Court, Nellore.

Accordingly, this application is allowed."
