THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.35670 of 2016 ORDER:
This writ petition under Article 226 of Constitution of India is filed to declare the action of the 3rd respondent in registering FIR No.193 of 2016, as illegal and arbitrary.
Heard and perused the material available on record. The case of the petitioner is that a case has been registered against the petitioner in Crime No.193 of 2016 of Charminar Police Station, Hyderabad, for the offences punishable under Sections 406, 420, 468 and 471 IPC and that earlier a case has been registered against the petitioner in Crime No.175 of 2016 of Charminar Police Station, Hyderabad, for the very same offences and the petitioner was released on bail. The grievance of the petitioner is that though a confession statement has been obtained by the police in respect of the present crime, they have registered the present crime against the petitioner after the petitioner has been released on bail.
Considering the grievance of the petitioner, the 3rd respondent is directed to complete the investigation in FIR No.193 of 2016 as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioner. The petitioner is further directed to report before the 3rd respondent daily at 10.00 a.m. from 07.11.2016 for a period of fifteen (15) days. Accordingly, the Writ Petition is disposed of. No costs.
