HON'BLE SMT.JUSTICE T.RAJANI CRIMINAL PETITION No.8435 of 2017 ORDER:
This criminal petition is filed under Section 482 of the Code of Criminal Procedure, 1973, seeking to quash the proceedings in C.C.No.21 of 2013 on the file of the Judicial Magistrate of First Class, Siddipet, Medak District.
Heard the learned counsel for the petitioner and the learned Public Prosecutor for the 1st respondent.
Learned counsel for the petitioner submits that there are civil disputes between the parties. It is also brought to the notice of this Court that no discharge petition is filed by the petitioner before the court below. Therefore, there still exists an alternative remedy for the petitioner. Hence, I do not consider that this is a case where powers vested in this Court under Section 482 Cr.P.C., need to be invoked.
The criminal petition is accordingly dismissed. Petitioner is at liberty to exhaust his alternative remedy of filing discharge petition before the Court below.
