ORDER:

This Criminal Petition is filed before this Court for grant of bail to the Petitioner who is arrayed as accused No.2 in Crime No.32 of 2026 of Kanchanbagh Police Station, Hyderabad, registered for the offences punishable under Sections 143(1)(f), 111, 75 of the Bharatiya Nyaya Sanhita (for short 'BNS') and Sections 31 4 and 5 of the Immoral Traffic (Prevention) Act, 1956.

The brief facts of the case are that, on 18.02.2026, basing on reliable information about a brothel being run at Hafeez Baba Nagar, Hyderabad, the police conducted a raid, during which accused persons were found operating the brothel by procuring women and allowing customers for prostitution. Two victim women were rescued, one customer was caught, and cash, mobile phones, condoms and a two-wheeler were seized. Based on the same, the police registered a case against the petitioner for the aforementioned offences.

Heard Sri B. Chinnapa Reddy, learned counsel appearing on behalf of the petitioner as well as Sri M. Ramachandra Reddy, learned Additional Public Prosecutor for respondent-State.

Learned counsel for the petitioner submitted that the petitioner is innocent of the said allegations and there is no such immoral traffic conducted in the house of the petitioner. It is further submitted that the petitioner is no way connected with the said crime and the petitioner is falsely implicated in the present case. The petitioner is in jail since 18.02.2026 and the material part of the

investigation is already completed and there is no past criminal history against the petitioner. Therefore, he prayed the Court to grant bail to the petitioner by allowing this criminal petition.

On the other hand, learned Addl. Public Prosecutor opposing the petition stating that the alleged offences are heneous and serious in nature and the role of the petitioner is clearly established through the statements of the victims and further contended that the material part of the investigation is not yet completed. Therefore, he prayed the Court to dismiss the petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioner is in jail from 18.02.2026, who is arrayed as accused No.2. The allegation against the petitioner is that she instigated the victims and introduced the accused No.1. As seen from the record, LW1 to LW12 were examined and even according to the prosecution, there is no other case pending against the petitioner. Considering the facts and

circumstances of the case, the nature of the allegations, the stage of investigation, and the duration of incarceration, this Court finds it appropriate to grant bail to the petitioner/accused No.2, subject to the following conditions.

i.

The petitioner/accused shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned VII Additional Chief Judicial Magistrate, Hyderabad District at Nampally.

ii.

The petitioner/accused shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner/accused shall abide by the conditions stipulated in

Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
