THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.29254 OF 2017 ORDER:

Petitioner challenges the order, dated 26.04.2017, of Tahsildar, Dichpally, Mandal, Nizamabad District, holding that he was subsequent purchaser of the subject land. In fact, earlier the said land was resumed by order dated 09.11.2015 and the same was challenged before this Court in W.P.No.9297 of 2017.

The said Writ Petition was allowed by order dated 23.03.2017 remitting the matter for fresh consideration and on such consideration, the order impugned is passed. Petitioner contends that aggrieved thereby, he preferred appeal and the said appeal is pending consideration before the Revenue Divisional Officer, Nizamabad District. Alleging inaction on the appeal preferred by the petitioner and on the contrary construction is being undertaken, this Writ Petition is filed.

Having regard to the same, the Writ Petition is disposed of directing the Revenue Divisional Officer, Nizamabad District, to consider the appeal preferred by the petitioner and pass appropriate orders, as warranted by law, as expeditiously as possible preferably within a period of three weeks from the date of receipt of a copy of this order. Status quo obtaining as on today with regard to the possession shall be maintained till such decision is taken. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in the Writ Petition shall stand closed.
