HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.34172 of 2014 ORDER:
There is no representation on behalf of the petitioner. The prayer sought in the writ petition is as under: "... to issue appropriate writ, order or direction more particularly one in the nature of writ of Mandamus declaring the action of the respondent No.3 not filing charge sheet against accused No.1, 5 and 6 in Crime No.176/2010 registered under Section 498(A) IPC and Section 3 and 4 of Dowry Prohibition Act as arbitrary, illegal against Article 19 and 21 of the Constitution of India. Consequently, direct the 3rd respondent to file final report in Crime No.176/2010 against remaining accused by allowing this writ petition in the interest of justice."
Learned Government Pleader appearing for the respondents placed on record written instructions dated 16.10.2019 issued by the Sub-Inspector of Police, Medak Town Police Station, Medak District.
From a perusal of the said written instructions, it is evident that basing on the complaint of the petitioner, a case in Crime No.176 of 2010 was registered for the offence punishable under Section 498-A IPC and Sections 3 and 4 of the Dowry Prohibition Act of Medak Town Police Station on 23.10.2010. After investigation, a charge sheet was filed and the same was numbered as C.C.No.41 of 2011 on the file of the learned Judicial Magistrate of First Class, Medak. It is also mentioned in the written instructions that when the said C.C.No.41 of 2011 was pending, both the parties have compromised before the Lok Adalat on 03.07.2017.
In view of the above said facts and circumstances, no further cause would survive in the writ petition. Accordingly, the writ petition is closed. No order as to costs.
