THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM Writ Petition No.41197 of 2014 ORDER:

The petitioner filed the present writ petition stating that the 1st respondent is proceeding with the case without considering the material placed on record and without giving proper opportunity. Except this bald allegation, there is no material for the Court to come to such conclusion. At any rate, even before any order is passed, it is impossible for this Court to come to a conclusion that the concerned authority will not consider the material placed on record and will not consider the arguments of the parties. However, learned counsel for the petitioner submits that to enable the petitioner to espouse his cause, he filed a petition to reopen the case, at the stage when the matter was reserved for orders and as on date, no orders have been passed. Learned Assistant Government Pleader for Revenue places on record, on instructions that, the request of the petitioner was accepted and the case was reopened and notices have also been issued.

Recording the submission made by the learned Assistant Government Pleader, the writ petition is dismissed as infructuous. There shall be no order as to costs.

The miscellaneous petitions filed in this writ petition shall also stand disposed of.
