Heard the learned counsel for the petitioners and learned Government Pleader for Civil Supplies. The principal challenge of the petitioners is against the implementation of the guidelines issued under G.O.Ms.No.52, dated 18.12.2008, G.O.Ms.No.39 dated 22.9.2012 and G.O.Ms.No.10 dated 28.5.2014.

At the time of hearing, it is brought to the notice of this Court that the respondents have completed the process of selection and appointed Fair Price Shop dealers on 19.2.2015 insofar as shops of the petitioners 1 to 5 and 7 are concerned. Having regard to the subsequent development, learned counsel for the petitioners requests the Court to give liberty to the petitioners to avail the remedy of appeal.

In the circumstances, the petitioners 1 to 5 and 7 are given liberty to avail the remedy of appeal, if they are so advised, within six weeks from the date of receipt of a copy of this order against the order dated 19.2.2015 whereunder Fair Price Shop

dealers were appointed by the respondents.

Insofar as petitioners 6 and 8 are concerned, learned Government Pleader for Civil Supplies by referring to the stand taken in the counter affidavit at para 4, submits that their complaint is premature; that in respect of petitioner no.6 notification was not yet issued and in respect of petitioner no.8 only temporary arrangement is being continued and that petitioners 6 and 8 are distributing the essential commodities as such. In the circumstances, the respondents are directed to take appropriate steps to appoint the regular Fair Price Shop dealers within a period of two months from the date of receipt of copy of the order. Till regular arrangement is made, the respondents are directed to continue the existing arrangements insofar as petitioners 6 and 8 concerned.

With the above directions, the writ petition is disposed of. No costs. Miscellaneous Petitions if any pending shall stand closed.
