THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION Nos.13361, 14263 AND 25004 OF 2015 COMMON ORDER:

These three Writ Petitions are being disposed of by this common order, after hearing the learned counsel for the petitioners and the learned Government Pleader for the respondents. The petitioners are temporary dealers of Fair Price Shops of Govindapalli, Gumparmanudinne, Mahadevapuram, Sirivella and Rudravaram Villages of Kurnool District. The case of the petitioners is that though permanent dealers are appointed, they are denied of their avocation and therefore their cases should be considered for appointment on permanent basis. When notification was issued on 08.04.2015 seeking to fill up the vacancies caused by cancellation/resignation of newly formed Fair Price Shops in Nandyal Division, Kurnool District, the present Writ Petitions are filed.

As stated above, it is the case of the petitioners that they are all temporary dealers and there is no Government Order for appointing temporary dealers as permanent dealers without undergoing the process of selection. When a notification is issued for appointing the permanent dealers, it is open to the petitioners also to undergo selection process. But, they cannot stop the process of filling up of the vacancies on the ground that they are being continued as temporary dealers.

In the circumstances, these Writ Petitions are liable to be dismissed and are accordingly dismissed. There shall be no order as to costs.
