Heard.

2. The building permission application submitted by the petitioners on 20.02.2017 is rejected by the Commissioner, Ramagundam Municipal Corporation, on 20.02.2019. Aggrieved by the same, the present writ petition is filed.

3. The order is primarily challenged on the ground that the order does not contain the reasons in support of the decision rejecting the application and that too after two years from the date of submission of application. Counsel also submits that in the meantime by invoking the deemed clause, the petitioners have already undertaken construction work and grave prejudice would be caused to them if any coercive action is taken by the respondents and if the building permission application is rejected.

5. Apparently, there is no indication of reasons for rejection of the application of the petitioners. Since the rejection of building permission would have evil consequences to the petitioners, they are entitled to know the reasons for rejection of their application.

6. Therefore, the impugned order dated 20.02.2019 is set aside and the matter is remitted to the 2nd respondentRamagundam Municipal Corporation with a direction to consider the application of the petitioners afresh and pass appropriate orders by assigning due reasons.

7. Accordingly, the Writ Petition is allowed. Miscellaneous Petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ___________________ P.NAVEEN RAO, J 10th June, 2019.
