THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.8840 of 2018 ORDER:

In this writ petition, under Article 226 of the Constitution of India, the grievance of the petitioner is with regard to inaction of the respondents 2 to 5 in investigating into the case in Crime No.814 of 2015 on the file of Kukatpally Police Station, registered for the offence punishable under Section 379 of the Indian Penal Code. In the writ petition, a direction to transfer the case to Central Crime Station, Cyberabad, was also sought.

At the time of hearing of the matter on the earlier occasion, learned Government Pleader for Home (Telangana), on written instructions, submitted that the final report was filed, on 25.01.2017, before the Court of the learned IX Metropolitan Magistrate, Kukatpally at Miyapur, Cyberabad. However, on that day, learned counsel for the petitioner submitted that on verification, it came to the notice of the petitioner that no such final report was placed before the learned Magistrate by the office of the Court of the Magistrate for appropriate orders. Therefore, both the parties were directed to produce proof in support of their respective contentions by the next date of hearing.

The petitioner has not produced any proof in support of her contention. However, learned Government Pleader for Home produced a copy of notice in Form No.96, whereunder the

complainant/petitioner herein was informed about the filing of a referred report before the Court of the learned Magistrate. The said notice also reflects that the petitioner was informed that if she intends to oppose the report, she has to approach the Magistrate within the time specified therein. As the respondents produced proof in respect of filing of the final report, after due service of notice on the petitioner herein, no further cause survives for adjudication in this matter. 4.

Accordingly, the writ petition stands disposed of. There shall be no order as to costs.

Miscellaneous petitions pending, if any, in this writ petition shall stand closed.
