THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 29905 of 2017 ORDER:

Petitioner is a Gayatri Nagar Welfare Association. Its grievance is that respondent No.3 constructed a house in a place earmarked for park by encroaching 50 square yards of land. In that connection, it lodged a complaint on 05.07.2017 to respondent No.2 and when respondent No.2 has not taken any action, the present writ petition is filed.

Respondent No.2 is the Gram Panchayat, whereas the complaint, dated 05.07.2017, was given to Boduppal Municipality. This shows the careless way of filing the writ petition. If the petitioner has any grievance with regard to the encroachment of park land, it is open to it to take appropriate civil proceedings apart from bringing it to the notice of higher authorities. This Court cannot interfere at this stage and the petitioner cannot invoke the discretionary jurisdiction of this Court for settling this type of issue.

The writ petition is accordingly dismissed.
