CVNR,J S.A.No.1215 of 2018 03.08.2018 JUDGMENT:

This Second Appeal is filed assailing the concurrent findings of fact rendered by the trial Court and the lower appellate Court with regard to the factum of construction of septic latrine and running of a mutton shop by the appellants/defendants. 2.

The decree granted by the trial Court and confirmed by the lower appellate Court for mandatory injunction directing the appellants to remove the septic latrine and the mutton shop is based on appreciation of evidence on the questions of fact. Therefore, no substantial questions of law arise in this Second Appeal. 3.

The Second Appeal is, accordingly, dismissed. 4.

As a sequel to dismissal of the Second Appeal, I.A.No.3 of 2018 filed by the appellants for interim relief stands dismissed as infructuous.
